7405 SAYILI KANUN’UN SPOR KULÜPLERİ VE SPOR ANONİM ŞİRKETLERİYLE İLGİLİ MALİ HÜKÜMLERİNİN DEĞERLENDİRİLMESİ

Abstract
Spor, Ülkemizde yıllardır devlet tarafından desteklenen bir faaliyet olarak varlığını devam ettirmektedir. Sporla ilgili birçok alanda günün ihtiyaçları doğrultusunda düzenlemeler, değişiklikler yapılmıştır. Spor kulüplerinin ve spor faaliyetinde bulunan anonim şirketlerin yaşadığı hukuki ve mali sorunların Türk sporu üzerinde yaratacağı olumsuz etkilerden duyulan kaygılar sebebiyle 2022 yılında yürürlüğe konan 7405 sayılı Spor Kulüpleri ve Spor Federasyonları Kanunu, Türk Sporu’nda yeni bir dönemin başlangıcı olmuştur. Geniş kapsamlı idari, hukuki ve cezai düzenlemeler yapılarak spor sistemi yeniden yapılandırılmıştır. Kanun ile, spor kulüplerine ve spor anonim şirketlerine getirilen malî kısıtlamalarla birlikte, bazı söz konusu kısıtlamalara uyulmaması da suç olarak düzenlenmiştir. Spor anonim şirketlerine denk bütçe zorunluluğu bu Kanun ile getirilmektedir. Bütçe denkliği denetimini ilgili spor federasyonu gerçekleştirecektir. Ayrıca Kanun ile, spor kulüpleri ve spor anonim şirketleri açısından bazı tür kamu borçlarının bulunmaması zorunluluğunun konulması da bu anlamda dikkat çekicidir.
Çalışmamızda, 7405 sayılı kanunun mali hükümlerindeki düzenlemelere değinilerek Spor Kulüpleri ve Spor Federasyonları Kanunu’nun kulüplere getirdiği değişiklikler hakkında bazı tespit ve önerilere yer verilmiştir.

Abstract
Sports has continued its existence as a state-supported activity in our country for years. Regulations and changes have been made in many areas related to sports in line with the needs of the day. Due to concerns about the negative effects of legal and financial problems experienced by sports clubs and joint stock companies engaged in sports activities on Turkish sports, the Sports Clubs and Sports Federations Code No. 7405, which came into force in 2022, has become the beginning of a new era in Turkish Sports. The sports system has been restructured by making comprehensive administrative, legal and penal regulations. With the Code, along with the financial restrictions imposed on sports clubs and joint stock companies, non-compliance with some of these restrictions has also been regulated as a crime. This Code imposes a balanced budget obligation on sports joint stock companies. The budget balance audit will be carried out by the relevant sports federation. In addition, it is noteworthy in this sense that the Code requires sports clubs and joint stock companies not to have certain types of public debts.
In our study, some findings and suggestions were made about the changes brought to the clubs by the Code on Sports Clubs and Sports Federations by referring to the regulations in the financial provisions of Law No. 7405.
